Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Stirden mobile application and related services (collectively, the "Service") operated by Montes-Nexus LLC ("Stirden," "we," "us"). By downloading, installing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. About Stirden
Stirden is a personal accountability and mentorship application. It helps you define standards you live by, track daily actions tied to your goals, and connect with accountability partners ("Squad members") who help you keep your word. A built-in mentor — powered by artificial intelligence — provides coaching prompts, reflections, and proactive check-ins.
Stirden is not therapy, counseling, or medical care. The Stirden mentor is an AI-powered coaching tool. It is not a licensed mental health professional, physician, dietitian, or fitness trainer. The Service does not diagnose, treat, cure, or prevent any condition. If you are experiencing a mental health crisis, contact emergency services or a qualified professional immediately.
2. Eligibility
You must be at least 13 years old to use the Service. If you are under the age of 18, you may use the Service only with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.
3. Your account
You may create an account using Apple Sign-In, Google Sign-In, or another supported authentication method. You are responsible for:
- The accuracy of the information you provide.
- Maintaining the security of your sign-in credentials and devices.
- All activity that occurs through your account.
Notify us immediately at hello@stirden.com if you suspect unauthorized use of your account.
4. Subscription and payment
The Service is offered on a subscription basis through the Apple App Store. Subscription details (price, billing period, renewal terms) are displayed in the App Store before purchase.
- Auto-renewal: subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before the end of the current period. Payment is charged to your Apple ID on renewal.
- Free trial: if a free trial is offered, the trial converts to a paid subscription automatically at the end of the trial period unless you cancel before then.
- Managing your subscription: manage and cancel your subscription anytime from your Apple ID Account Settings (Settings → [your name] → Subscriptions on iOS).
- Refunds: all sales are final and subject to Apple's refund policy. Stirden cannot process refunds for App Store purchases directly. Refund requests must be submitted through Apple at reportaproblem.apple.com.
- Price changes: we may change subscription prices from time to time. We will provide notice through the App Store before any price change takes effect. Continued use after a price change constitutes acceptance of the new price.
5. Acceptable use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:
- Use the Service in violation of any applicable law or regulation.
- Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Use the Service to harvest or collect any information about other users without their consent.
- Interfere with or disrupt the Service or servers or networks connected to the Service.
- Attempt to gain unauthorized access to the Service or any other accounts, computer systems, or networks.
- Use any automated means (bots, scrapers, scripts) to access the Service.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Submit photos or content that you do not have the right to share, including photos of other people without their consent.
- Use the Service to deceive your accountability partners — for example, by submitting falsified or recycled photo proofs to fake completion of a commitment.
Violation of these rules may result in suspension or termination of your account.
6. Your content
You retain all rights to the content you submit to the Service (your standards, daily actions, messages, photos, voice recordings — collectively, "User Content").
By submitting User Content, you grant Stirden a worldwide, non-exclusive, royalty-free license to store, transmit, process, display, and use the User Content solely for the purpose of operating and improving the Service (including providing it to your chosen accountability partners and routing it through the third-party processors described in our Privacy Policy). This license terminates when you delete the User Content or your account, subject to backup retention and legal-hold exceptions.
You represent and warrant that you own or have the necessary rights and permissions to submit your User Content and that the User Content does not violate any third-party rights.
7. Squad (accountability partners)
The Service lets you invite other users to be your accountability partners ("Squad members") and to share specific standards and daily actions with them. When you share a commitment with a Squad member, that Squad member sees the commitment text, your progress, and any photo proof you submit for it. Squad members may verify or deny proof submissions.
You control which commitments are shared on a per-commitment basis. You may remove a Squad member or stop sharing a commitment at any time. Squad members may also choose to stop receiving updates from you.
8. AI mentor disclaimer
The Service includes an AI-powered mentor that provides personalized coaching prompts, reflections, and accountability check-ins. The mentor's responses are generated by artificial intelligence models (currently provided by Anthropic and xAI; see our Privacy Policy for details).
AI-generated responses may sometimes be inaccurate, incomplete, or unsuitable for your situation. Do not rely on the mentor for medical, legal, financial, mental-health, or any other professional advice. Always exercise your own judgment and consult qualified professionals when appropriate.
9. SMS communications
If you provide your phone number and opt in to SMS-based accountability features, you agree to receive recurring transactional and accountability SMS messages from Stirden as described in our Privacy Policy. Message and data rates may apply. Reply STOP to opt out at any time.
10. Apple Health integration
If you connect Apple Health, the Service reads only the specific data types you authorize and uses them to verify completion of relevant standards and actions. The Service does not write data back to Apple Health. You may revoke Apple Health permissions at any time in iOS Settings → Privacy & Security → Health.
11. Intellectual property
The Service, including all software, designs, text, graphics, logos, and trademarks (other than User Content), is owned by Stirden or our licensors and is protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial use, subject to these Terms.
You may not copy, modify, distribute, sell, lease, sublicense, or create derivative works of any part of the Service except as expressly permitted by these Terms.
12. Third-party services
The Service integrates with and depends on third-party services (such as Apple, Anthropic, xAI, Supabase, Twilio, PostHog, and Expo). We are not responsible for the availability, accuracy, or reliability of any third-party service, and your use of any third-party service is governed by that service's own terms and privacy policies.
13. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
14. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL STIRDEN, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, REGARDLESS OF THE LEGAL THEORY.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE, IN AGGREGATE, WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO STIRDEN IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
15. Indemnification
You agree to indemnify, defend, and hold harmless Stirden and our affiliates, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party right.
16. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if we reasonably believe you have violated these Terms, are using the Service in a manner harmful to other users or to Stirden, or for any other reason in our sole discretion. We will, where reasonably possible, provide notice and an opportunity to cure before termination.
Sections 6 (your content license — survival of license in already-distributed copies), 11 (intellectual property), 13 (disclaimers), 14 (limitation of liability), 15 (indemnification), and 18 (governing law and dispute resolution) survive termination.
17. Apple App Store additional terms
The following terms apply when you obtain the Service through the Apple App Store:
- These Terms are a contract between you and Stirden, not Apple. Apple is not responsible for the Service or its content.
- Your license to use the Service is non-transferable and limited to use on Apple-branded products that you own or control.
- Apple has no obligation to provide maintenance or support services for the Service.
- If the Service fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation.
- Stirden, not Apple, is responsible for addressing any claims relating to the Service, including product-liability claims, intellectual-property claims, and consumer-protection claims.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. Governing law and dispute resolution
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved exclusively in the state and federal courts located in Texas, and you consent to personal jurisdiction in those courts.
You and Stirden each waive any right to a jury trial. Any dispute or claim must be brought within one (1) year after the cause of action arose, or it is permanently barred.
19. Changes to these Terms
We may update these Terms from time to time. When we do, we will update the "Effective date" above and, for material changes, provide additional notice (such as an in-app notification). Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
